Terms of Use

These Terms of Use (“Terms”) are a binding agreement entered into by a user (“you”) and A Healthier Democracy doing business as Link Health (“we” or “us”). Please review these Terms before using the website Link-Health.org (our “Site”), and our Link Health AI Agent LEO and Link Health Dashboard (our “Tools”). By using our Site and Tools, you accept and agree to be bound and abide by these Terms and our Privacy Policy https://link-health.org/privacy-policy/ .

  1. Using the Site and Tools
    1. Purpose

Link Health provides the Site and Tools for the purpose of partners with clinics and community organizations to help patients enroll in essential benefits (collectively, the “Services”). Link Health is a 501(c)(3) organization.

  1. Age Requirement

The Site and Tools are offered and available to users who are 18 years of age or older. If you are not 18 years old, please do not use the Site or Tools.

  1. Conditions of Use

By using the Service, you represent that:

  • You have read and understand the Link Health Privacy Policy  https://link-health.org/privacy-policy/.
  • You are legally able to enter into a contract with Link Health.
  • You have not previously been prohibited from using the Site or Tools.
  • You will comply with all applicable local, state, national, and international laws while using the Site and Tools.

By using the Service, you also understand and agree that:

  • Link Health may make changes to the Site and Tools that add or remove features.
  • Access to the Site and Tools may be interrupted or unavailable without notice.
  • Link Health does not control and is not liable for the availability of third-party services linked to from the Site or the Tools.
  1. Prohibited Uses of the Site

In using the Site, you agree not to do, attempt, or encourage the following:

  • Knowingly provide false information to Link Health.
  • Impersonate any other person or entity.
  • Copy, modify, create derivative works of, or reverse engineer the Site, except where specifically permitted by law.
  • Embed, frame, reimplement, or otherwise redistribute the Site.
  • Interfere with the proper working of the Site with denial-of-service attacks, viruses, Trojan horses, worms, or other harmful or malicious techniques.
  • Attempt to gain unauthorized access to any parts of the Site or any server, computer, or database connected to the Site.
  1. Prohibited Uses of the Tools

In using the Tools, you agree not to do, attempt, or encourage the following:

  • Use the Tools for any illegal or unauthorized purpose, including by violating any federal, state, or local voter registration laws. 
  • Alter the Tools, including by removing Link Health’s trademarks or copyright notices. However, you may freely translate the tools into other languages for uses consistent with the purpose in Section 1.1.
  • Republish the Tools without express permission from Link Health.
  1. Violations of Terms

A breach or violation of any of the Terms will result in an immediate termination of your access to the Site and the Tools. 

  1. Intellectual Property

All content on the Site or in the Tools is owned or licensed by Link Health and is protected by national and international copyright, trademark, trade secret, and other intellectual property law.

Pursuant to these Terms, we grant you a worldwide, royalty-free, non-exclusive, non- transferrable, revocable license to use the Site and Tools in connection with the purposes described in Section 1.1.

  1. Changes and Updates

We may revise and update these Terms from time to time. All changes are effective immediately when we post them. It is your responsibility to check this page periodically for changes. Your continued use of our Site, our Tools, and other Link Health services after the posting of revised Terms means you accept and agree to the changes we make.

THE WEBSITE AND TOOLS ARE PROVIDED TO YOU “AS IS” AND WITHOUT WARRANTY OF ANY KIND. TO THE EXTENT PERMITTED BY LAW, LINK HEALTH DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, WITH RESPECT TO THE WEBSITE AND TOOLS, INCLUDING ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT, AND WARRANTIES THAT MAY ARISE OUT OF COURSE OF DEALING, COURSE OF PERFORMANCE, USAGE OR TRADE PRACTICE.

  1. Limitation of Liability

THE LIABILITY OF ANY PARTY UNDER ANY PROVISION OF THESE TERMS SHALL BE LIMITED TO ACTUAL LOSSES. TO THE EXTENT PERMITTED BY LAW, NO PARTY SHALL BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER, EVEN IF THE OTHER PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. 

  1. Indemnification

TO THE EXTENT PERMITTED BY LAW, YOU AGREE TO INDEMNIFY AND HOLD HARMLESS LINK HEALTH AND ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, LICENSORS, SUPPLIERS, SUCCESSORS, AND ASSIGNS FROM AND AGAINST ANY CLAIMS, LIABILITIES, DAMAGES, JUDGMENTS, AWARDS, LOSSES, COSTS, EXPENSES, OR FEES ARISING OUT OF OR RELATING YOUR USE OF THE WEBSITE AND TOOLS. 

  1. Dispute Resolution

Should any dispute arise between the parties related to these Terms, the parties agree to submit the dispute to a mutually agreed mediation service. The parties agree to cooperate to choose a neutral mediation service and mediator. Any fees and expenses related to mediation will be share equally between the parties.

If the parties cannot resolve the dispute through mediation, either party may file suit in a court of competent jurisdiction in accordance with Section 4.5 of these Terms.

  1. Choice of Law and Venue

These Terms, and all matters arising out of these Terms, are governed by the laws of the State of Massachusetts of the United States of America. All claims arising under these Terms must be brought in the United States District Court for Massachusetts or a state court of Massachusetts in Suffolk County. Each party consents to the personal jurisdiction of these courts for the purpose of any claim arising under these Terms.

  1. Waiver and Severability

No failure by a party to assert any right set out in these Terms shall be deemed a continuing waiver of such right or a waiver of any other term or condition. 

If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.

  1. Entire Agreement

These Terms, including the Link Health Privacy Policy, constitute the entire agreement between you and Link Health regarding the Site and Tools and supersede all prior and contemporaneous agreements.

 

Consent Form for Data Use in Public Benefit Programs Enrollment

Consent to Use Data: By signing this form, you consent to us using and saving your data to assist you in enrolling in public benefit programs.

Confidentiality and Security: We ensure that all personal and sensitive data collected through our programs are kept strictly confidential. Access to this data is limited to authorized personnel who have a legitimate need to access it in connection with their job responsibilities. We employ industry-standard security measures, including encryption and secure storage, to protect data from unauthorized access, alteration, or disclosure.

Data Collection and Use: The collection of data is limited to what is necessary for the effective delivery and enhancement of our services. We are transparent about how we use the data we collect and ensure it is used only for the purposes for which it was collected. We collect data with your explicit consent and use it to provide better service, improve our programs, execute research, and communicate effectively with our participants. At any time, you may contact us to opt out of communication from us and to request that your information be deleted from our systems.

Data Sharing and Disclosure: We do not publish, share, or disclose any personal data collected through our programs without explicit consent, except where required by law. When data is shared with third parties, it is done under strict confidentiality agreements, ensuring the continued protection of the data. We ensure that third-party service providers adhere to our data privacy standards.

Data Storage and Retention: All data is stored securely, employing industry-standard encryption and security measures. We retain data only for as long as is necessary for the purposes for which it was collected, or as required by law. Upon reaching the end of the retention period, data is securely deleted or anonymized.

Staff Training and Awareness: Our staff receive regular training on data privacy and security, ensuring they understand their responsibilities and the importance of protecting personal data. We foster a culture of privacy awareness and vigilance among our employees.

Link Health provides program screening (patient engagement), enrollment support, and related communications to assist with public benefit applications. We do not guarantee eligibility, approval, benefit amount, processing time, or outcomes; the official program agencies make final determinations.

Intellectual property

Unless otherwise noted, the Link Health website content, graphics, and downloadable materials are owned by Link Health or licensed to us. You may use partner toolkit materials for implementation with your organization, but you may not sell, republish, or misrepresent them without permission.

Government portals and other websites

Our website or messages may link to third-party sites (including government benefit portals). We’re not responsible for the content or privacy practices of third-party sites.

Disclaimers

Our website and services are provided “as is” and “as available.” We make reasonable efforts to keep information accurate and systems available, but we do not warrant uninterrupted access, error-free operation, or that information will always be current.

To the maximum extent permitted by law, Link Health will not be liable for indirect, incidental, special, or consequential damages arising from your use (or inability to use) the website or services.
