This privacy policy (“Privacy Policy”) is designed to inform users of our website (the “Site”) about how we gather and use personal information collected by us in connection with the Site. We will take reasonable steps to protect user privacy consistent with the guidelines set forth in this Privacy Policy and with applicable U.S. laws. In this Privacy Policy, “user,” “your” or “you” refers to any individual or entity using the Site, whether by browsing the Site, registering with us by creating an account and providing consent or participating in any other activities available through Link Health, either online, via chatbot, text message, or on Site with a clinical partner. References to “we”, “us” and “our” herein refer to Link Health.

We are committed to protecting your privacy. This Privacy Policy (the “Policy”) governs how we treat the Personal Information that we collect and receive from you in connection with your use of the Services (as defined in the Terms of Use  https://link-health.org/terms-and-conditions/).

By using the Services, you agree to the terms of this Policy. We reserve the right, at our sole discretion, to modify or change this Privacy Policy at any time with or without prior notice to you. The date of the last update will be posted at the top of this Policy for your convenience. “Personal Information” is information that individually identifies you, such as your mobile phone number or username/e-mail address, as well as the messages you send through in connection with the Services.  Personal Information can also include information that we acquire from service providers or partner organizations. 

Link Health Website Visitors

When you visit the Website, we automatically collect certain information about your device, including information about your web browser, IP address, time zone, and some of the cookies that are installed on your device. Additionally, as you browse the Website, we collect information about the individual web pages or products that you view, what websites or search terms referred you to the Site, and information about how you interact with the Website (collectively “Device Information”).

What We Collect from You

We receive your mobile phone number when you communicate with us by SMS text message. We also receive any other content that you send us in connection with the Services by SMS text message or through our Tools (as defined in the Terms of Service). Our tools include our AI-powered LEO chatbot, which can be accessed via NFC device or QR code as well as our text messaging platforms. We use this information to (a) provide you with the Services, (b) process and respond to inquiries and support requests, (c) if necessary, contact you with important announcements or messages, and (d) provide anonymous reporting for internal partners.

Each message that you send through the Services is stored with our third-party support vendor. We may retain these messages internally, along with our third-party support vendor. Link Health utilizes servers owned by third parties. Reasonable and appropriate safeguards to prevent the Use or Disclosure of PHI or other information are adhered to. 


Disclosure of Your Information

We will not rent or sell your Personal Information to other companies or individuals, unless we have your consent. We may use or disclose such information in any of the following limited circumstances:

  • We have your consent.

  • We provide such information to trusted businesses or persons for the sole purpose of processing personally identifying information on our behalf. When this is done, it is subject to agreements that oblige those parties to process such information only on our instructions and in compliance with this Policy and appropriate confidentiality and security measures.
  • We provide such information to third parties who have entered into non-disclosure agreements with us.
  • We provide such information to a company controlled by, or under common control with, Link Health for any purpose permitted by this Policy.

  • We transfer Personal Information about you if Link Health is, or its assets are, acquired by or merged with another company.

We may share aggregated information with others without further notice. An example of this would be the number of people who used the Services in a given month, or the total number of texts sent/responded to, in a given week.


Submissions

Any comments, feedback, notes, messages, ideas, suggestions or other communications (collectively, “Submissions”) sent by you to Link Health shall be and remain the exclusive property of Link Health. Your submission of any such Submissions shall constitute an assignment to Link Health of all worldwide right, title and interest in all copyrights and other intellectual property rights in the Submissions. Link Health will be entitled to use, reproduce, disclose, publish and distribute any Submissions you submit for any purpose whatsoever, without restriction and without compensating you in any way. For this reason, we ask that you not send us any Submissions that you do not wish to assign to us, including any confidential information or any original creative materials such as stories, product ideas, computer code or original artwork. You agree not to submit any Submissions that may be submitted in violation of law or any agreement or obligation to keep the content of such Submissions confidential. Link Health expressly disclaims any interest in any Submissions that you are not authorized to submit. Of course, any information you submit which personally identifies you will be subject to our Privacy Policy.


Trademarks, Names and Logos

All trademarks, names and logos used on the Site or delivered via the Services are owned by Link Health or Link Health’s third party licensors (unless otherwise stated). Your use of the Services and the Sitedoes not allow you to infringe those rights or the rights of the third parties which may exist in material contained in this site. No license is expressly impliedly granted within or as a result of your use of the Services or the Site. Link Health is not responsible for any violations of any intellectual property rights by any user of the Services. Upon receiving your complaint, we may, in our sole discretion, terminate the account of the user who appears to be infringing your intellectual property rights.


Security

Link Health takes precautions to ensure the security of your Personal Information. However, we cannot guarantee that hackers or unauthorized personnel may gain access to your Personal Information despite our efforts. You should note that in using the Services, your information will travel through third-party infrastructures which are not under our control (such as a third-party SMS delivery platform or your carrier network).

We cannot protect, nor does this Policy apply to, any information that you transmit to other users. You should never transmit personal or identifying information to other users.


Opting Out

Link Health provides you with the ability to opt out of the Services for any reason. SMS messaging allows you to reply “STOP” in order to stop receiving support responses and messages.

Access and Updating of Information

Services Limitations

You are solely responsible for all security information relating to your use of the Services, and are fully responsible for all activities that occur under your mobile phone number.

Legal Exception

Notwithstanding the above, we may in any event use Personal Information, and any other information collected through the Site to the extent required by law or legal process, to resolve disputes, to enforce our agreements (including this Privacy Policy and the Terms of Use with you, or if in our reasonable discretion use is necessary to protect our legal rights or to protect third parties.

Amendments 

Link Health may modify or amend this policy from time to time. If we make any material changes, as determined by Link Health, in the way in which Personal Information or Device Information is collected, used or transferred, we will notify you of these changes by modification of this Privacy Policy, which will be available for review by you at the Site. Notwithstanding any modifications we may make, any Personal Information and Device Information collected by Link Health from you will be treated in accordance with the privacy policy in effect at the time information was collected, unless we obtain your consent otherwise.

  • Website forms: When you provide a telephone number and submit a form that includes the SMS disclosure immediately beneath the phone field.
  • Verbal consent: During case-management calls conducted via Zoom Phone, when authorized.
  • Text-initiated consent: When you text us first or use a published keyword to initiate communication.
  • Paper or in-person consent: When you authorize SMS in writing on Link Health intake or consent forms.

What We Send (and Don’t Send). We send informational/service messages such as: enrollment assistance for SNAP, WIC, Lifeline, HEAP, MSP, TAFDC, and related benefits; scheduling; reminders; follow-ups; document checklists; and links to official resources. We do not send adult content. We do not send lending or loan offers via SMS.

Message Frequency & Charges. Message frequency may vary. Message and data rates may apply depending on your mobile plan and carrier.

Opt-Out and Help. You may opt out at any time by replying STOP (or END, CANCEL, UNSUBSCRIBE, QUIT) to 617-604-2080.
